A vote for the measure would have ensured the Federalists at least a portion of the electoral votes. A vote against the measure would have guaranteed that all the electoral votes would go to the Democratic-Republicans. Since the State Senate was still Federalist dominated, no election law was passed and the legislature cast the vote, with Jefferson receiving one more electoral vote than Adams.
